Terms of sale.
What is agreed.
Before anything starts.
Updated 24 October 2026
1. Scope
These terms apply to the services provided by Nicolas Rousselin, sole trader operating Tramevia, whose identity and contact details appear in the legal notice: websites, online shops and booking, custom tools, dashboards, assistants, films, website fixes and maintenance.
They apply to business clients and consumers alike; some clauses concern only one of them, as stated. The accepted quote prevails over these terms in case of conflict. The client’s own terms apply only with Tramevia’s written agreement. This English version is a translation: the French version prevails.
2. Quote and order
The “from” prices shown on the website are indicative. Each service is covered by a free quote setting out the scope, deliverables, steps, price, provisional timeline, payment terms and how long the offer is valid.
The order is concluded when the client returns the signed quote or accepts it in writing, including by email, and, if the quote provides for one, once the deposit is paid. A request outside the scope of the quote is covered by an additional quote, accepted before the work is done.
3. Price and payment
Prices are in euros. VAT not applicable (French article 293 B of the CGI). The quoted price is fixed for the scope described. Any deposit and payment schedule appear on the quote; the balance is payable by bank transfer by the date shown on the invoice.
Third-party services the project needs (domain name, hosting, subscriptions, licences, payment provider) are taken out in the client’s name and paid by the client, unless the quote says otherwise.
Business clients: any late payment automatically incurs penalties at three times the French statutory interest rate, plus a fixed recovery fee of €40 (article L441-10 of the French Commercial Code). No discount is given for early payment. Consumers: unpaid sums bear interest at the statutory rate after a formal notice that remains unanswered.
If an invoice remains unpaid after formal notice, Tramevia may suspend the work until payment; the timeline then moves back accordingly.
4. Right of withdrawal
When the contract is concluded at a distance or off-premises with a consumer, the consumer has 14 days from the conclusion of the contract to withdraw, without giving reasons or paying any penalty (article L221-18 of the French Consumer Code). The same right applies to a business with five employees or fewer, when the contract is concluded off-premises and falls outside its main activity (article L221-3).
To withdraw, send the form below, or any other unambiguous statement, to contact@tramevia.com before the period ends. Sums paid are refunded within 14 days, using the same means of payment.
If the client expressly asks for the work to start before the period ends, they owe an amount proportionate to the service provided until they withdraw (article L221-25). The right of withdrawal is lost once the service has been fully performed before the period ends, with the client’s prior express consent and acknowledgement of that loss (article L221-28).
Withdrawal form (complete and return only if you wish to withdraw):
To Nicolas Rousselin, Tramevia, 7 impasse du Docteur Pallet, 33910 Saint-Denis-de-Pile, France, contact@tramevia.com:

5. How the work is carried out
Tramevia carries out the work with care, in line with good professional practice, under an obligation of means. Previews are shown at every step, and the client approves them before the next one. The number of revision rounds included appears on the quote.
The client provides the texts, images, logos, information and access needed, holds the rights to them, and indemnifies Tramevia against any claim about them. The quoted timeline starts when these items are received; any delay in providing them moves the timeline back accordingly.
6. Delivery and approval
At the end of the work, Tramevia presents the result to the client. The client reports in writing any difference from the quote within the period stated on it or, failing that, within 15 days; such differences are corrected free of charge. Without any reservation within that period, or as soon as the client asks for it to go live, the work is considered approved, without prejudice to statutory guarantees.
7. What is delivered belongs to you
Once the price is paid in full, Tramevia assigns to the client, exclusively, the economic copyright in the items created specifically for them: rights of reproduction, performance and adaptation, on any medium, worldwide and for the full legal term of the rights. Source files and code are handed over, and the website goes live on accounts in the client’s name.
Third-party components (open-source libraries, fonts, images, plugins or themes) remain under their own licences, which are passed on to the client. Tramevia keeps its know-how and its generic tools and methods. Unless the client refuses in writing, Tramevia may list the work among its references.
8. Maintenance
Maintenance is a monthly subscription whose content appears on the quote: checks, updates, backups and small changes within the stated limit. It renews automatically each month and can be cancelled at any time by email; cancellation takes effect at the end of the current month, and a month that has started remains due.
Any price change is announced by email at least one month in advance; the client may cancel before it takes effect.
9. Liability
Tramevia is not responsible for content supplied by the client, for the operation of third-party services (host, payment provider, platforms), or for changes made by the client or a third party after delivery.
Business clients: Tramevia’s liability is limited to direct, proven damage, up to the price paid for the service concerned or, for maintenance, the sums paid over the last twelve months. Consumers: these limits apply only as far as the law allows.
10. Statutory guarantees
Consumer clients benefit from the statutory guarantees of the French Consumer Code and Civil Code, including, where it applies, the legal guarantee of conformity for digital content and services (articles L224-25-12 et seq. of the French Consumer Code).
11. Force majeure
Neither party is liable for a failure caused by force majeure within the meaning of article 1218 of the French Civil Code. The obligations concerned are suspended for its duration; after two months, either party may terminate the contract in writing.
12. Personal data
How the data of clients and of people who get in touch is handled is described on the Privacy page. When Tramevia processes personal data on the client’s behalf, for example a shop’s customer data, the parties sign the commitments required by article 28 of the GDPR.
13. Complaints, mediation and governing law
Any complaint should be sent in writing to contact@tramevia.com. If it is not resolved, consumer clients may use the consumer mediator free of charge, within one year of their written complaint: CM2C, 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net.
These terms are governed by French law. Between businesses, failing an amicable settlement, any dispute falls under the competent courts for Tramevia’s place of business. Consumers may bring proceedings before any court the law allows.
